Corporations Point-in-Time Service Updates

The Corporations Point-in-Time Service has been updated to include the Corporations Amendment (Portfolio Holdings Disclosure) Regulations 2021 (Cth) and the National Consumer Credit Protection Amendment (Small Business Exemption No. 2) Regulations 2021 (Cth).

Corporations Amendment (Portfolio Holdings Disclosure) Regulations 2021

The Treasury Laws Amendment (Improving Accountability and Member Outcomes in Superannuation Measures No. 1) Act 2019 (the Act) introduced measures to increase the amount and quality of information available to superannuation fund members and other stakeholders. These measures have subsequently been amended by the Treasury Laws Amendment (Your Future, Your Super) Act 2021.

The Corporations Amendment (Portfolio Holdings Disclosure) Regulations 2021 support those amendments by prescribing the manner in which information provided under the portfolio holdings disclosure regime must be organised.

National Consumer Credit Protection Amendment (Small Business Exemption No. 2) Regulations 2021

This Regulation amends the National Consumer Credit Protection Regulations 2010 to reinstate the temporary small business exemption from responsible lending obligations that are contained under the National Consumer Credit Protection Act 2009, relating to the coronavirus economic response and covering credit with a partial small business purpose. It also makes an amendment to the exemption period to prevent the responsible lending obligations from being temporarily re-imposed on a portion of credit activity (that has a partial small business purpose) ahead of their removal by other legislation.
