OHS in Commonwealth Games - Duty of Care?

Tuesday 28 September 2010 @ 12.17 p.m. | Industrial Law

With the XIX Commonwealth Games in India quickly approaching, spectators and employees should question their own health and safety.

The Australian Government has advised the nation of the high threat of Terrorism and the uncomparable building standards in India to Australia.

In this risky situation, is there an obligation for the Government to ensure the health and safety of Australian Commonwealth government employees?

Norton Rose have released an article on Mondaq stating that:

"Sending a large government employed delegation in the face of adverse security, safety and heath risk assessments from credible sources is potentially a breach of the duty of care."

The article sends a clear warning to Global Business, reminding them of the risks of sending employees around the world.

Do you think the Government is in breach of the duty of care?
