The SA Government will push ahead with specific legislation to regulate franchising above and beyond the existing national Franchising Code of Conduct.

The article examines the contents of the now lapsed bill introduced in SA Parliament before sitting sessions ended in 2009. It discusses in depth ideas like South Australian Law for Franchising being the de facto law over National regulation; An all-powerful Commissioner of Franchises and consistently including components of good faith in all franchising legislation.

Can you think of any other State Legislation that replicates these regulatory and retribution provisions? Is there a better way for Franchising reform to move forwards?
