The Federal Magistrates Court of Australia has passed its decision on the unfair dismissal case of Brown v DS & MJ Batten T/AS Pane in the Glass [2012] FMCA 296. The case mainly concerned an instance of alleged unfair dismissal. The questions were whether adverse action had been taken against the employee due to physical disability and whether the employee was dismissed due to temporary absence from work due to injury.

Ultimately, the court dismissed the application.
