Deloitte to Review Competition and Consumer Act 2010

Deloitte Access Economics’ Dr Ric Simes has been appointed by the Minister for Broadband, Communications and Digital Economy to undertake an independent legislative review required under section 151DD of the Competition and Consumer Act 2010.

The Review will relate to the statutory authorisations provided to NBN Co in Division 16 of the Competition and Consumer Act. These provisions provide NBN Co with the authorisation to support its achievement of the Australian Government’s policy of Uniform National Wholesale Pricing without contravening Part IV of the Act; that is restrictive trade practices.

Section 151DA provides that NBN Co is permitted to engage in specified conducts that may otherwise being construed as restrictive trade practices provided that it is “reasonably necessary” to achieve uniform national wholesale pricing.

The review will include the release of a public Issues Paper to seek feedback from stakeholders in regards to NBN Co conduct in relation to the relevant sections.
