Income Tax Point-in-Time Service Updates

The Income Tax Point-in-Time Service has been updated to include the Income Tax Assessment (1997 Act) Amendment (Building a Stronger and Fairer Super System and Other Measures) Regulations 2026 (Cth).

Income Tax Assessment (1997 Act) Amendment (Building a Stronger and Fairer Super System and Other Measures) Regulations 2026

These Regulations amend the Income Tax Assessment (1997 Act) Regulations 2021 (Cth) (the Principal Regulations) to prescribe certain values, calculations, and methods so that all applicable superannuation interests are properly assessed for the purposes of the Division 296 tax, which was inserted by the Treasury Laws Amendment (Building a Stronger and Fairer Super System) Act 2026 (Cth).

These Regulations include amendments to: 

  • prescribe the attribution rules for working out a member's share of a fund's Division 296 earnings;
  • prescribe rules for valuing defined benefit interests and certain other superannuation interests;
  • make adjustments to total superannuation balance (TSB) values for defined benefit interests subject to a family law payment split, where that interest is not able to be split between the member spouse and non member spouse at the time of the order or agreement; and
  • update some of the method assumptions in Schedules 1A and 1AA of the Principal Regulations, which are used to value notional taxed contributions and defined benefit contributions.

These amendments have been updated in the Point-in-Time Income Tax Service current to 25 June 2026 (NB: subscription required).
