Employment Point-in-Time Service Updates

The Employment Point-in-Time Service has been updated to include the Treasury Laws Amendment (Financial Reporting System Reform) Act 2026 (Cth) (Act No 61 of 2026) and the Workplace Relations Legislation Amendment (Building Cooperative Workplaces No. 1) Act 2026 (Act No 62 of 2026).

Act 61 of 2026

This Act amends the Australian Securities and Investments Commission Act 2001 (Cth) (the Principal Act) to combine the core functions and powers of the Australian Accounting Standards Board (AASB), the Auditing and Assurance Standards Board (AUASB), their respective offices, and the Financial Reporting Council (FRC) into a single entity, the External Reporting Australia.

The Act also makes consequential amendments to various other Acts, including the Fair Work (Registered Organisations) Act 2009 (Cth), to update references to the former body and repeal any obsolete definitions.

Act 62 of 2026

This Act amends the Fair Work Act 2009 (Cth) (the Fair Work Act), the Fair Work (Registered Organisations) Act 2009 (Cth) and the Independent Contractors Act 2006 (Cth), to improve the operation of the workplace relations framework. This Act aims to:

• introduce measures to support more efficient Fair Work Commission (Commission) processes, subject to appropriate safeguards;
• allow the Commonwealth, in certain circumstances, to preference employers whose employees are covered by an enterprise agreement as a means of incentivising bargaining and supporting productivity gains and improved wages and conditions;
• provide a streamlined pathway for parties to an existing supported bargaining agreement to obtain a subsequent supported bargaining authorisation to commence bargaining for a new supported bargaining agreement without unnecessary procedural steps;
• provide for a separate Road Transport Contractor High Income Threshold set by regulation to apply to regulated road transport contractors. This will address current inflexibility in the provisions which prevents road transport contractors from having meaningful access to the regulated worker protections in the Fair Work Act;
• amend reporting timeframes for the Administrator of the Construction and General Division of the Construction Forestry Manufacturing and Energy Union;
• entitle members of the Road Transport Advisory Group to travel allowance;
• make minor amendments to the ministerial membership of the National Construction Industry Forum and the way regulations may prescribe travel allowance for members.
