Crime Point-in-Time Service Updates

The Crime Point-in-Time Service has been updated to include the Secrecy Provisions Amendment (Sunsetting Provision) Act 2026 (Cth) (Act No 53 of 2026).

Act 53 of 2026

This Act amends the Criminal Code Act 1995 (Cth) (the Criminal Code) to extend the sunsetting date of section 122.4 of the Criminal Code. Section 122.4 of the Criminal Code creates an offence where a person communicates information and the person made or obtained the information by reason of his or her being, or having been, a Commonwealth officer or otherwise engaged to perform work for a Commonwealth entity; the person is under a duty not to disclose the information; and the duty arises under a law of the Commonwealth.

The Act extends the sunsetting date by 6 months from 29 June 2026 to 29 December 2026. The extension ensures that non-disclosure duties continue to have criminal liability while broader reforms to the Commonwealth secrecy framework, including to implement recommendations of the Attorney-General's Department Secrecy Review, are considered by Parliament.
