Competition and Consumer Point-in-Time Service Updates

The Competition and Consumer Point-in-Time Service has been updated to include the Treasury Laws Amendment (Professional Standards Schemes) Regulations 2026 (Cth) and the Competition and Consumer (Industry Code—Electricity Retail) Amendment (No. 2) Regulations 2026 (Cth).

Treasury Laws Amendment (Professional Standards Schemes) Regulations 2026

The Regulations give effect to decisions of the Professional Standards Councils to make the Association of Australian Certifiers Professional Standards Scheme and remake the Australian Institute of Building Surveyors, Strata Community Association (NSW) Limited, Australian Property Institute Valuers Limited and Association of Consulting Surveyors National professional standards schemes. As part of its remake, the Association of Consulting Surveyors National Professional Standards Scheme has been renamed the Surveyors Australia Professional Standards Scheme. There are no significant differences between the remade schemes and their previous versions.

Competition and Consumer (Industry Code—Electricity Retail) Amendment (No. 2) Regulations 2026

The purpose of the Regulations is to amend the Competition and Consumer (Industry Code—Electricity Retail) Regulations 2019 (Cth) to clarify the retailer obligation to make the Solar Sharer Offer (SSO) to eligible customers and to strengthen the capability of the Australian Competition and Consumer Commission (ACCC) to enforce SSO obligations.

The Regulations achieve this by:

• emphasising that retailers must make the SSO ‘available’ to eligible customers;
• including civil penalties to provisions that require retailers to offer the SSO, and to receive consent from a customer before onboarding them onto the SSO; and
• relocating the compliance and enforcement provisions for the SSO into Part 2 of the Electricity Retail Code to ensure the ACCC retains all compliance and enforcement functions.
