Saturday 29 May 2010 @ 1.34 a.m. | Trade & Commerce

The Bill was introduced into the House of Reps and reached Second Reading stage on 27 May 2010. It amends the Trade Practices Act 1974 (TPA) to clarify the operation of various provisions relating to mergers and acquisitions. It also inserts a statement of interpretative principles into the unconscionable conduct provisions of the Australian Consumer Law (ACL) and the Australian Securities and Investments Act and unifies ss 21 and 22 of the ACL (formerly ss 51AB and 51AC of the TPA). The changes to the unconscionable conduct provisions will generally be reflected in the ASIC Act.
