Qantas Airways Limited v Australian Licensed Aircraft Engineers Association

The Federal Court of Australia has handed down its decision in the case of Qantas Airways Limited v Australian Licensed Aircraft Engineers Association [2012] FCAFC 63. The court found that there was no denial of procedural fairness arising from the federal magistrate’s judgement.

The case concerned an appeal of an industrial law matter. The respondent had alleged that the appellant had altered the employee’s position to his prejudice. The court also addressed the issue of coercion arising from the case. Namely, whether the magistrate deciding the case on another basis other than the one raised as the basis for unlawfulness constituted a denial of procedural fairness.

The Court ultimately decided that the appeal should be allowed in part only and dismissing the bulk of the appeal on the ground that the appellant had not made out any of their grounds of appeal.
