Employment Point-in-Time Service Updates

The Employment Point-in-Time Service has been updated to include the Fair Work Amendment (Protecting Penalty and Overtime Rates) Act 2025 (Cth) (Act No 37 of 2025).
Act 37 of 2025
This Act amends the Fair Work Act 2009 (Cth) to protect penalty and overtime rates for modern award-reliant employees. The Act intends to ensure that penalty and overtime rates remain a part of the modern awards safety net by legislating a principle:
- ensuring the specified penalty or overtime rates in modern awards cannot be reduced; and
- closing loopholes in the modern awards safety net that allow employers to 'roll up' penalty and overtime rates into a single pay rate, that do not fairly compensate award reliant employees for the penalty rates and overtime they would have otherwise received.
These amendments have been updated in the Point-in-Time Employment Service current to 2 September 2025. (Note: Subscription required).
