The Corporations Service has been updated to include the Treasury Laws Amendment (Help to Buy Exemptions) Regulations 2025 (Cth).

Treasury Laws Amendment (Help to Buy Exemptions) Regulations 2025

The purpose of the Regulations is to support the efficient and effective operation of the Help to Buy program (Help to Buy) established under the Help to Buy Act 2024 (Cth), by ensuring that, where Housing Australia and participating lenders have obligations in relation to Help to Buy arrangements, these are regulated by the Program Directions. Specifically, the Regulations amend the:

  • Corporations Regulations 2001 (Cth) to declare that a Help to Buy arrangement is not a 'derivative' for the purpose of the Corporations Act 2001 (Cth); and
  • National Consumer Credit Protection Regulations 2010 (Cth) to prescribe that the National Credit Code does not apply to the provision of credit by Housing Australia under a Help to Buy arrangement.

These amendments have been updated in the Point-in-Time Corporations Service current to 22 September 2025. (NB: subscription required).
