Corporations Point-in-Time Service Updates

The Corporations Service has been updated to include the Treasury Laws Amendment (Strengthening Financial Systems and Other Measures) Act 2025 (Cth) (Act No 72 of 2025), the Regulatory Reform Omnibus Act 2025 (Cth) (Act No 73 of 2025), and the Payment Systems Legislation Amendment (2025 Measures No. 1) Regulations 2025 (Cth).

Act 72 of 2025

This Act amends the Corporations Act 2001 (Cth) (the Corporations Act), the Competition and Consumer Act 2010 (Cth), and the law relating to charities, taxation and the Financial Regulator Assessment Authority; and makes minor and technical amendments to Treasury portfolio legislation. 

The amendments made by this Act to the Corporations Act aim to enhance the beneficial ownership disclosure obligations that already apply to entities listed on Australia's financial markets. These amendments seek to bolster the substantial holding and tracing notice regimes that govern the disclosure of beneficially owned interests in listed entities.

Act 73 of 2025

The Act aims to support a ‘tell us once’ approach to government service delivery, improve access to government services, reduce regulatory burden on Australians and businesses, and boost productivity and economic growth across the Australian economy. The Act amends outdated administrative provisions in various Acts including the Corporations Act, to support increased efficiency and better service delivery from a broad range of Commonwealth regulators and agencies. 

Payment Systems Legislation Amendment (2025 Measures No. 1) Regulations 2025

These Regulations amend the Australian Securities and Investments Commission Regulations 2001 (Cth), the Corporations Regulations 2001 (Cth), and the Payment Systems (Regulation) Regulations 2006 (Cth) to support the amendments contained in the Treasury Laws Amendment (Payments System Modernisation) Act 2025 (Cth) (the Amendment Act). The Regulations support the Amendment Act, including by prescribing special regulators, heads of special regulators and eligible delegates in relation to special regulators that are nominated special regulators, thereby operationalising the modernised payments regulatory framework.
