Income Tax Point-in-Time Service Updates

The Income Tax Point-in-Time Service has been updated to include the Treasury Laws Amendment (Strengthening Financial Systems and Other Measures) Act 2025 (Cth) (Act No 72 of 2025) and the Income Tax Assessment (1997 Act) Amendment (Critical Minerals) Regulations 2025 (Cth).

Act 72 of 2025

This Act amends the Corporations Act 2001 (Cth) (the Corporations Act), the Competition and Consumer Act 2010 (Cth), and the law relating to charities, taxation and the Financial Regulator Assessment Authority; and makes minor and technical amendments to Treasury portfolio legislation. 

The amendments made by this Act to the Corporations Act aim to enhance the beneficial ownership disclosure obligations that already apply to entities listed on Australia's financial markets. These amendments seek to bolster the substantial holding and tracing notice regimes that govern the disclosure of beneficially owned interests in listed entities.

Income Tax Assessment (1997 Act) Amendment (Critical Minerals) Regulations 2025

These Regulations prescribe certain critical minerals processing activities that are intended to be eligible for the Critical Minerals Production Tax Incentive (CMPTI) but would not meet the general test set out in the Income Tax Assessment Act 1997 (Cth). The Regulations prescribe the processing activities and outcomes relating to the processing of high purity alumina (HPA), graphite; and percursor cathode-active material (pCAM).
