The Federal Court has handed down its decision in Fair Work Ombudsman v National Jet Systems Pty Ltd [2012] FCA 243. The court had to decide whether there was duress or conduct negating effective choice in a workplace agreement. The court decided ultimately that the conduct relied upon the by applicant did not constitute duress.
In a separate case, the Federal Magistrates Court of Australia also handed down its decision in Fair Work Ombudsman v S H Millicent Pty Ltd [2012] FMCA 178. The court was presiding over a penalty hearing for contravention of provisions in the Workplace Relations Act. It ultimately found that the defendant was in breach of the Act.
