Corporations Case Law Update: 29 March 2012

The Federal Court of Australia handed down its decision in the case of Gould Bros & Co Pty Limited (Administrators Appointed), in the matter of Gould Bros & Co Pty Limited (Administrators Appointed) [2012] FCA 285 on the 22 March 2012. The key issue was how Part 5.3A of the Corporation Act 2001 (Cth) would operate with regards to a funding agreement.

The court ruled that Part 5.3A should operate in respect to the first plaintiff.
