Fair Work issues social media warning

Fair Work Australia says it is unlikely to have set a precedent by ordering the reinstatement of a worker who had been sacked over racist and sexist Facebook comments.

The industrial tribunal says Linfox did not have policy on employees' use of social media last year when it sacked truck driver Glen Stutsel over derogatory comments made about two of his managers.

Fair Work noted the comments were outrageous and distasteful but said the company did not have sufficient grounds to sack Mr Stutsel.

The truck driver's evidence that he thought it was a private site and did not know how to take down offensive posts was taken into account.
