NSW Government to Review Retail Lease Act

The New South Wales Government is currently reviewing the Retail Leases Act 1994 as a result of its recognition that the retail sector is slowly morphing into an online based industry. The traditional retail store is quickly on the decline with customers exponentially boosting the growth of online sales. 

The purpose of the Government’s review is to address a number of specific problems that the issue has highlighted:

  • Firstly, the Registrar of Retail Tenancy Disputes and the Office of the NSW Small Business Commissioner has identified a number of concerns and problems in administering the Act.
  • Secondly, the Government has received a number of submissions outlining continuing and emerging problems within the retail leasing market which are not adequately addressed by the current Act.

To accentuate all this, recent changes in the retail sector including the growth of online sales and a relative decline in traditional bricks and mortar retail stores means that certain provisions of the Act may no longer be appropriate.

Submissions to comment on the review are due by Friday 7 February 2014. The current list of issues is not intended to be exhaustive and the purpose of the review is also to highlight other issues that may be relevant so that all stakeholders may participate in the review.
