Employment Point-in-Time Service Updates

The Employment Point-in-Time Service has been updated to include the Fair Work and Other Legislation Amendment (Secure Jobs, Better Pay) Regulations 2023 (Cth).

Fair Work and Other Legislation Amendment (Secure Jobs, Better Pay) Regulations 2023

This instrument primarily amends the Fair Work Regulations 2009 (Cth) in response to legislative changes made by the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth). This includes amendments to:

  • clarify how certain matters dealt with in the statement of principles on genuine agreement are to be taken into account for the purpose of variations of single-enterprise agreements;
  • prescribe signing requirements relating to various bargaining instruments;
  • amend the prescribed Notice of Employee Representational Rights Form in Schedule 2.1 to the Fair Work Regulations 2009;
  • amend the information provided in Schedule 5.2 of the Fair Work Regulations 2009 that the President of the Fair Work Commission (FWC) must provide to the Minister;
  • prescribe requirements that the FWC must be satisfied have been meet before a person who is not an eligible protected action ballot (PAB) agent is appointed the PAB agent for a PAB;
  • empower the President of the FWC with the discretion to delegate certain powers and functions to FWC staff; and
  • prescribe the rate of travel allowance payable to eligible members, substitute members and invited participants of the National Construction Industry Forum, to attend Forum meetings.

This instrument also repeals the Building and Construction Industry (Improving Productivity) Regulations 2017 (Cth).
