Cases Update: Thomson v STX Pan Ocean Co Ltd

The Full Court of the Federal Court released today the appeal decision of Thomson v STX Pan Ocean Co Ltd. This case deals with Trade Practices Act 1974 (Cth) legislation, mainly sections 52, 75B and 82.

The case raised issues on misleading and deceptive conduct where an officer of charterer made post-contractual representations that the charterer was imminently “ready, willing and able” to perform the contract when it was insolvent.
