South Australia Workers’ Compensation Laws Review Likely

The South Australian premier has indicated that the government believes the state's current workers' compensation scheme is failing some injured workers and needs to be improved.

Changes to the laws have been flagged to help cut the scheme's overall cost and to assist those "caught [up] in the system" return to work.

At the recent ALP convention the premier is reported as indicating that:

"For most injured workers who are able to get back to work quickly, the scheme works well ..But a small number of workers get stuck in the scheme for a long time ... For these workers, they don't feel like they are getting compensation. They feel that the system punishes them. This drives up the cost of the scheme for all employers."

The premier then indicated that the government intended to undertake an improvement project to look at the scheme's legislation and administration, with a view to making changes to the law in 2013.

A likely change indicated by the premier was the medical panel process through which injured workers are assessed.
