Fees increase for Administrative Tribunals across the country

As of the beginning of this month several fees increased for parties wishing to use the NSW Administrative Decisions Tribunal (NSWADT), the Victorian Civil and Administrative Tribunal (VCAT), the Queensland Civil and Administrative Tribunal (QCAT) and the ACT Civil and Administrative Tribunal.

NSW

Schedule 1 of the Administrative Decisions Tribunal Amendment (Fees) Regulation 2013 recites various new NSWADT fees. An application for the tribunal to decide a matter, in most cases, has increased by $2 to $77; if the tribunal is to be constituted by two or more members the fee has now increased by $4 to $161. Lodging an internal or external appeal costs has increased from $309 to $317. The Registrar can charge a fee of up to $39 for any service not specified in the Regulation, an increase of $1 over last year’s fee. Victoria

The Victorian Civil and Administrative Tribunal (Fees) Regulations 2013 recites the fees from 1 June 2013 for proceedings in the Victorian Civil and Administrative Tribunal. The Regulations also sets out fees for issuing warrants and witness summonses, inspecting the register and other additional services by VCAT. The regulation specify how the fees are calculated and proceedings which do not attract fees. Also effective 1 June Practice note PNVCAT 6 Hearing Fees provides information on when fees are payable, liability to pay, requesting a fee waiver, consequences of non-payment of fees and refunds.

Queensland

Various QCAT fees also changed on 1 July 2013 as per the Justice Legislation (Fees) Amendment Regulation (No. 1) 2013.  An application for QCAT to hear an anti-discrimination matter remains free of charge; however, the fee to lodge an appeal is $569.20.

ACT

In the ACT, fees increased on 1 July 2013, and along with several new categories of fees. There is no filing fee for referrals from the Human Rights and Discrimination Commissioner, however, an appeal by a natural person costs $449, and the fee for a corporation is $898.
